Agreement Disclosure - Power Pay First National Bank PowerPay Online Agreement and Disclosure Statement This is the First National Bank’s PowerPay Online Banking Service Agreement and disclosure. Each and all of the depositors are referred to as “you” and “your”. The First National Bank is referred to as “we,” “our,” and “us”. This online banking agreement contains the terms and conditions governing the online bill pay service. As used in this document, the term “agreement” means this document and the PowerPay Online Application. These terms and conditions are in addition to those that apply to any accounts you have with us or any other services you obtain from us. First National Bank may amend or change this agreement and give you notice via regular mail or electronic mail, using the address that appears on your account records. You acknowledge that you have received, understand and agree to the specific disclosures (Truth In Savings, Funds Availability, Electronic Funds Transfer, Deposit Account Agreement, and Your Information is Safe) that apply to each of your accounts with First National Bank. The disclosures were provided to you at the time you opened your accounts with us. The account disclosures continue to apply while this user agreement is in effect, even though they may be or have already been revised. Security and Privacy First National Bank understands how important privacy is to our customers. We have taken steps to insure your security and privacy for your personal and financial dealings with the bank. PowerPay Service It is easy to pay bills online. PowerPay Online allows you to pay bills electronically or by check. You can arrange this for any current, future and recurring bills from your checking account, up to the available balance of your account. In order to enroll in PowerPay you must also be enrolled in NetTeller. You may pay any merchant or individual through the online service that has a U.S. address and phone number. You may not make a payment of alimony, settlement of brokerage accounts, child support, taxes, and or any other governmental fees or court-directed payments through PowerPay Bill Pay. First National Bank’s PowerPay Online Bill Pay service is provided by Princeton E-com. By furnishing us with the names of your payees (means the person or entity to whom you wish a bill payment be directed) or merchants and their addresses, you authorize us to follow the payment instructions that you provide through Online Banking. We will remit to the payee/merchant, as instructed by you, on the day (current or future) that you request. You authorize us to debit your checking account and remit funds to the Payee on your behalf. While it is anticipated that most transactions will be processed and completed by the Payment Date, it is understood that due to circumstances beyond our control, particularly delay in handling and posting payments by slow responding Payees, some transactions may take a day or even a few days longer to be credited by your Payee to your Payee account. We will use our best efforts to make all your payments properly. However, we shall incur no liability if we are unable to complete any payments initiated by you through PowerPay because of any one or more of the following circumstances: If, through no fault of ours, your Checking Account does not contain sufficient funds to complete the transaction or the transaction would exceed the credit limit of your Overdraft Protection, Savings to Checking and/or Bounce Protection accounts; The date and/or time settings on your PC are incorrect; PowerPay or Online Services is not working properly and you know or have been advised by us about the problem before you execute the transaction; The Payee mishandles or delays a payment sent by the processor; The Payee is not a business Payee; The Payee information necessary to complete the payment stored on your PC’s hard drive and/or First National Bank NetTeller systems has been lost; or, You have not provided us with the correct name, phone number or account information for the Payee, or you have not provided us with accurate personal information either during enrollment or on your Bill Payment Profile within Online Banking, or you have otherwise provided incomplete payment instructions. Personal Banking Regular & SuperNow Accounts: First 10 bills free, .50 per bill thereafter
Hometown Checking: First 3 months free, then $3.00/ Mo. up to 5 bills, and .50 per bill thereafter If more than one accountholder would like to have PowerPay on the same account, the second person will be charged $3.00 per month, the first 5 bills will be free, then .50 per bill thereafter. Business Banking Business: First 10 bills free, then .50 per bill thereafter
Stop Payment Fee - $22.50 These fees may be amended from time to time. All other fees applicable to your accounts remain in effect. PowerPay fees are assessed to your checking account at statement cycle each month for transactions incurred up to the statement cycle time. Payments Schedule All payments are made from your designated checking account. To schedule a payment, you must provide the name of your payee, the amount of your payment and the date or dates on which you want your payment to be scheduled. Although you can enter payment instructions through PowerPay 7 days a week, 24 hours a day, excluding maintenance and other availability windows, payments will be processed only on business days. Any scheduled future payments may be made on a non-business day (weekend, holiday, etc.), but will be initiated on the next business day. If any recurring payments fall on a day which is not a business day in a particular month, the payment may be initiated on the prior business day. This processing sequence and timing must be considered in your planning when making bill payment requests. It may take up to 8 business days for the U.S. Postal Service to deliver the check and up to 3 business days for electronic payments to your Payee/Merchant on the desired date. You will need to allow an appropriate amount of time for it to be delivered and posted to your account due to merchant posting issues. First National Bank will not be responsible for late fees, additional interest, and/or penalties for payments you’ve scheduled during any account grace periods that may not be received until after your grace period. Stop, Change or Edit a PowerPay Transaction You have the right to stop or change any scheduled bill prior to 1:00 pm EST on the last business day before the payment date in the event the payment date is a non-business day (weekend, holiday, etc.). Transfer Limitations If your account is a savings or money market (HIFI) deposit account, federal law requires that an Account Holder may make no more than six (6) transfers and/or withdrawals during any one (1) calendar month or statement cycle (the period from one statement to the next), to another of your accounts with us or to a third party by means of a preauthorized transfer or automatic transfer. You are permitted to transfer from one of these accounts to a loan account that you have with us. No more than three (3) of the six (6) transfers may be made by check, draft, debit card, or similar order made by you and payable to third parties. Login User ID and Password Each authorized owner of an eligible Checking Account can access that account to pay bills if they have completed a NetTeller or PowerPay Application. Each owner will have a unique ID and a Password with which to access the Online Banking system. Each owner is responsible for transactions initiated by individuals with whom the Access ID and Password have been shared. In order to prevent unauthorized access to your accounts and to prevent unauthorized use of Online Services, you agree, by using PowerPay, to keep confidential, and to not give or make available your User ID or Password, or other means to access your account(s) with anyone. This agreement will apply to each account owner, signatory or authorized signer. First National Bank does not have a duty to monitor payments made through PowerPay. If you are a business owner, and an authorized representative uses online banking to pay bills which are not yours, you assume the entire risk of loss. You also agree to indemnify and hold harmless First National Bank from any loss, liability and expenses arising out of or in any way connected with such use. Tell us at once if you believe your access ID and/or Password have been lost or stolen. Telephoning is the best way of keeping your possible losses down by calling 740-962-3911 or 800-441-3811. Cancellation If, after signing up for PowerPay Online Bill Payment, you decide you no longer wish to have this service as an option on your First National Bank account, please call the bank and speak with a Customer Service Representative at 740-962-3911 or 800-441-3811, or by writing to us at the address listed on the last page of this agreement. After notifying us of your wish to cancel, you agree to allow us ten (10) days to process your termination request. First National Bank in its sole discretion may cancel access to PowerPay and/or NetTeller or any of its services for any individual User ID or for an entire business customer relationship. If you wish to cancel PowerPay Online, you must cancel all future bill payments by deleting those payments yourself prior to canceling your PowerPay Service. This will ensure that future payments and transfers made by you will not be duplicated. We will automatically delete all outstanding payment orders (all individual payments and all recurring payments) once we have been notified that your service has been terminated. First National Bank will automatically cancel your PowerPay service if you do not use this service for 90 consecutive days. You will not receive a refund of any service fee if you cancel. The bank may cancel or suspend your PowerPay service, in whole or in part, at any time without prior notice. Cancellation or suspension shall not affect your liability or obligations under this Agreement. NetTeller and PowerPay give you the opportunity to send First National Bank an e-mail message. Please keep in mind that e-mail is not a secured method of communication. Confidential information and account numbers should NOT be sent over Internet E-mail. Changes Except as otherwise required by law, rule, or regulation, First National Bank may change the terms and conditions of this agreement as well as any charges or fees, from time to time and at any time. You will be notified prior to the changes taking effect. Damages The foregoing shall constitute our entire liability and your exclusive remedy. In no event shall we be liable for any loss, injury, or damages, whether direct, indirect, special, incidental, exemplary, or consequential, including lost profits caused by PowerPay or the use thereof, or arising in any way out of the installation, use or maintenance of your personal computer hardware, equipment, software, or any Internet access service. Warranty Disclaimer The PowerPay online services and related documentation are provided “as is” and we do not make any warranties of any kind, either expressed or implied, concerning the hardware, software, or any part thereof, including without limitation, and warranties of merchantability or fitness for a particular purpose Acknowledgement Each account holder signing the online banking application for PowerPay acknowledges receipt of this agreement, and agrees to the terms set forth in this agreement, as amended from time to time.
